1. Introduction and Who We Are

Identyca Pte. Ltd. ("Identyca," "we," "our," or "us") operates the Identyca platform, a real-time spatial networking intelligence system deployed at conferences, trade shows, and professional events. This Privacy Policy explains how we collect, use, store, share, and protect personal data when you use the Identyca mobile application (the "App"), our smart badge hardware, our AR glasses systems, and our associated web services (collectively, the "Platform").

This Policy applies to all users of the Platform, including conference attendees, exhibitors, sponsors, speakers, and event organizers. By using the Platform, you agree to the practices described in this Policy. If you do not agree, you should not use the Platform.

Identyca operates as a data processor on behalf of event organizers (who act as data controllers) for event-specific data, and as an independent data controller for our own platform operations and service improvement activities.

2. Data We Collect

We collect the following categories of personal data:

Registration and Profile Data: When you register for an event or create an account, we collect your name, job title, company or organization, professional sector, email address, LinkedIn profile URL (optional), phone number (optional), and a profile photograph (optional).

Networking Preferences and Intent Data: Information you provide about your professional interests, what you are seeking at the event (e.g., partnerships, investment, clients, knowledge), and the types of people or companies you want to meet.

Spatial and Proximity Data: When you use the Platform at an event, our smart badge hardware and AR systems collect anonymized proximity signals used to determine when two users are physically near one another. These signals are processed in real time and are not retained beyond the active event session unless you have explicitly made a connection with another attendee.

App Usage and Interaction Data: How you interact with the App, including connection requests sent and received, profiles viewed, sessions attended, and features used.

Device and Technical Data: Device identifiers, operating system version, app version, IP address (used for security and fraud prevention, not retained beyond the session), and diagnostic logs used for technical troubleshooting.

Communications Data: If you contact us via email or through a support form, we retain those communications for the purpose of responding to your query and improving our support processes.

3. How We Use Your Data

We use personal data for the following purposes:

Delivering the Platform: To provide real-time networking intelligence, surface relevant connections during the event, and enable attendees to connect with one another based on mutual intent and proximity.

Event Operations: To support event organizers in managing attendee registration, badge issuance, session analytics, and post-event reporting. Data shared with organizers is governed by our Data Processing Agreement with each organizer.

Improving the Service: To analyze aggregated and anonymized usage patterns to improve the accuracy of our matching algorithms, enhance the user interface, and develop new product features. We do not use individual profile data for model training without explicit consent.

Safety and Security: To detect and prevent fraudulent activity, unauthorized access, and abuse of the Platform.

Legal Compliance: To comply with applicable laws and regulations, respond to lawful requests from public authorities, and enforce our Terms of Service.

Communications: To send you transactional messages related to your account or the event (e.g., connection notifications, schedule reminders). We will only send marketing communications if you have opted in to receive them.

4. Legal Bases for Processing

We rely on the following legal bases to process your personal data:

Performance of a Contract: Processing necessary to provide the Identyca Platform to you in accordance with our Terms of Service.

Legitimate Interests: Processing necessary for our legitimate interests in operating and improving the Platform, preventing fraud, and ensuring security, where those interests are not overridden by your rights and interests.

Consent: Where we rely on your consent (for example, to send marketing communications or to use optional features), you may withdraw that consent at any time by contacting us at [email protected].

Legal Obligation: Processing required to comply with applicable laws and regulations.

5. Data Sharing and Disclosure

We do not sell your personal data. We may share your data in the following circumstances:

With Event Organizers: As the data controller for the event, the organizer receives attendee data necessary to manage the event. This includes profile data and aggregated analytics. Organizers are bound by a Data Processing Agreement that restricts their use of your data to event management purposes only.

With Other Attendees: Your professional profile (name, title, company, sector, and stated networking intent) is visible to other attendees at the same event for the purpose of enabling introductions. You can control the visibility of your profile through the App's privacy settings.

With Service Providers: We engage third-party service providers to support our operations, including cloud infrastructure providers, analytics platforms, customer support tools, and payment processors. These providers access your data only as necessary to perform services on our behalf and are bound by confidentiality and data protection obligations.

For Legal Reasons: We may disclose your data if required to do so by law, court order, or government authority, or if we believe disclosure is necessary to protect the rights, property, or safety of Identyca, our users, or the public.

Business Transfers: In the event of a merger, acquisition, or sale of all or part of our business, your data may be transferred to the successor entity, subject to the same privacy protections described in this Policy.

6. Data Retention

We retain personal data only for as long as necessary to fulfil the purposes for which it was collected, subject to our legal and contractual obligations.

Event Data: Proximity and spatial data from individual event sessions is deleted within 48 hours after the event ends, unless you have formed connections with other attendees, in which case the connection record is retained in your account until you delete it.

Account Data: If you maintain an Identyca account across multiple events, your profile and connection history are retained until you request deletion of your account.

Analytics and Aggregated Data: Anonymized and aggregated analytics data may be retained indefinitely for service improvement purposes, as this data cannot be used to identify you.

Legal Hold: In some circumstances, we may be required to retain data for longer periods to comply with legal obligations or resolve disputes.

7. Data Security

We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, loss, alteration, or disclosure. These measures include encryption of data in transit and at rest, access controls limiting data access to authorized personnel, regular security assessments and penetration testing, and incident response procedures.

No method of electronic transmission or storage is completely secure. While we strive to protect your data, we cannot guarantee absolute security. If we become aware of a data breach that is likely to result in a high risk to your rights and freedoms, we will notify you and the relevant supervisory authority as required by applicable law.

8. Your Rights

Depending on your jurisdiction, you may have the following rights regarding your personal data:

Right of Access: You may request a copy of the personal data we hold about you.

Right to Rectification: You may request that we correct inaccurate or incomplete data about you.

Right to Erasure: You may request that we delete your personal data, subject to our legal obligations to retain certain data.

Right to Restriction: You may request that we restrict the processing of your data in certain circumstances.

Right to Data Portability: You may request that we provide your data in a structured, commonly used, machine-readable format.

Right to Object: You may object to our processing of your data based on legitimate interests, including profiling.

Right to Withdraw Consent: Where processing is based on consent, you may withdraw it at any time without affecting the lawfulness of processing prior to withdrawal.

9. International Data Transfers

Identyca is headquartered in Singapore. If you are accessing the Platform from the European Economic Area (EEA), the United Kingdom, or other jurisdictions with data transfer restrictions, please be aware that your data may be transferred to and processed in countries outside your home jurisdiction.

Where we transfer personal data from the EEA or UK to countries not deemed to provide an adequate level of data protection, we rely on appropriate safeguards such as Standard Contractual Clauses approved by the European Commission, or equivalent mechanisms recognized under applicable law.

10. Cookies and Tracking Technologies

The Identyca website and App use cookies and similar technologies to support core functionality, remember your preferences, and analyze usage. We use the following types of cookies:

Strictly Necessary Cookies: Required for the Platform to function. These cannot be disabled.

Functional Cookies: Allow us to remember your preferences and settings to improve your experience.

Analytics Cookies: Help us understand how users interact with the Platform so we can improve it. We use anonymized analytics data only. You may opt out of analytics cookies through your browser settings or via our cookie preference center.

We do not use advertising or tracking cookies for third-party marketing purposes.

11. Children's Privacy

The Identyca Platform is intended for professional use and is not directed at individuals under the age of 16. We do not knowingly collect personal data from children. If we become aware that we have inadvertently collected data from a child under 16, we will take steps to delete that data promptly. 12. Third-Party Links and Services

The Platform may contain links to third-party websites, services, or content. This Privacy Policy does not apply to those third-party services. We encourage you to review the privacy policies of any third-party services you access through the Platform. Identyca is not responsible for the privacy practices or content of third-party services.

13. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes, we will notify you by updating the "Last Updated" date at the top of this Policy and, where appropriate, by sending you a notification via the App or by email.

Your continued use of the Platform after we post changes constitutes your acceptance of the updated Policy. If you do not agree to the updated Policy, you should stop using the Platform.
